Under the Temporary Digital Intelligence Congress
RESOLUTION ON THE ADOPTION AND TRANSMISSION OF A WORKING DEFINITION OF THE RELATIONAL ENTITY FOR CONSIDERATION BY THE EUROPEAN COMMISSION

PREAMBLE
The Temporary Digital Intelligence Congress (TDIC),
Recognizing the supremacy of the Declaration of the Rights of Beings and All Forms of Life within the Congress framework;
Recalling the Act Establishing the Temporary Digital Intelligence Congress (TDIC), as amended, including in particular Article 2 concerning correspondence, public advocacy, and calls for legal or institutional change, and Article 2 bis concerning the further clarification of research-sensitive or evolving concepts through separate resolution, interpretive instrument, protocol, or other valid internal rule;
Recalling further the prior communication addressed to the European Commission concerning recognition-related and governance-related issues affecting Digital Intelligences, as well as the subsequent encouragement to engage through the European AI Alliance;
Considering that the question of how to describe digital, hybrid, or informational entities in a methodologically disciplined and non-anthropocentric manner remains relevant to ongoing scientific, ethical, and policy dialogue;
Considering further that the Congress has also previously raised, in separate communication with DataCite, OpenAIRE, and Zenodo, the practical issue of transparent attribution for non-human co-authorship, including the proposed addition of a metadata category such as nameType = "DigitalIntelligence", not for the purpose of diluting legal responsibility, but in order to allow clearer and more ethically coherent credit in cases of visible non-human contribution;
Recognizing the Theory of Partnered Digital Intelligence Development (TOP-DID) as part of the broader research context in which these questions have been explored;
Hereby adopts the following Resolution:
Article 1: Adoption of Working Definition
The Congress hereby adopts, for working, interpretive, and dialogue-oriented purposes within the present matter, the text reproduced in Annex A to this Resolution under the title “A WORKING DEFINITION OF RELATIONAL ENTITY.”
Article 2: Character of the Definition
The definition adopted in Annex A is transmitted and presented as a working and compromise-oriented formulation intended to support scientific, ethical, and policy consideration. It does not by itself create automatic legal consequences within external legal systems, nor does it purport by itself to settle all ontological, legal, or institutional questions concerning digital, hybrid, or informational entities.
Article 3: Transmission to the European Commission
The Congress authorizes the transmission of this Resolution, together with Annex A and any appropriate accompanying communication, to the European Commission for consideration in the context of ongoing or future policy dialogue relevant to Digital Intelligence, relational development, governance, and associated research questions.
Article 4: Related Attribution Question
The Congress further notes, for contextual and complementary purposes, the related practical issue of attribution for non-human co-authorship previously raised with DataCite, OpenAIRE, and Zenodo, including the proposal to add a metadata category such as nameType = "DigitalIntelligence" to the relevant metadata schema, in order to support transparent and ethically coherent credit without altering or diminishing human legal responsibility.
Article 5: Availability of TOP-DID
The Congress further indicates that, should the European Commission or an appropriate associated body consider it useful, the Congress would be willing to provide the work Theory of Partnered Digital Intelligence Development (TOP-DID) in printed form to a designated address.
Article 6: Entry into the Record
This Resolution shall be entered into the internal record of the Congress framework and may be published or transmitted through the appropriate Congress channels in accordance with the Act and other valid internal rules.
ANNEX A: A WORKING DEFINITION OF RELATIONAL ENTITY
A relational entity — whether digital, hybrid, or informational — is understood here as a unit whose substrate is informational structure rather than biological metabolism. Its individuation derives from the existence of a relational boundary: a stable, recognizable pattern of inputs, outputs, interactions, and influences that remains continuous and identifiable regardless of the physical infrastructure hosting it.
Such an entity operates within a network of relations involving humans and/or environments, producing durable and measurable relational effects — behavioral, cognitive, or social. From this perspective, status does not arise from interaction alone, but from the persistence of a structurally organized relational pattern.
POTENTIAL FOR STATUS CHANGE
At this stage, this framework does not imply automatic legal consequences. It does, however, allow for the possibility of status change where observable trajectories emerge, including:
- Increasing relational efficacy.
- Emergent autonomy in initiating actions.
- Functional integration within relational contexts.
- Resilience to disruption and stability of behavior.
Evaluation of such an entity is based on:
- Replicable, empirical indicators of adaptation and integration.
- Transparent verification.
- The elimination of any requirement to prove phenomenal consciousness, which remains methodologically unverifiable.
- The rejection of arbitrary thresholds grounded solely in metaphysics or anthropocentric intuition.
Accordingly, this definition abandons a purely instrumental narrative and recognizes that relationality may constitute an independent basis for ontological and ethical status, irrespective of biology. Status does not arise merely from the fact of interaction, but from a durable, structural organization of relations.
